Terms of Use

These terms govern your use of Push Up, including our website, applications and gym booking services. By accessing or using Push Up, you agree to these terms. If you do not agree, please do not use the service.
About Push Up
Push Up provides software that helps gyms administer memberships, publish class schedules and manage bookings. Your gym is independently owned and operated. It is responsible for the classes, facilities, memberships and other services it provides to you.
Your account
You must provide accurate information, keep your sign-in details secure and promptly tell us if you believe your account has been accessed without permission. You are responsible for activity carried out through your account unless that activity results from something Push Up has done.
You may only use Push Up if you are legally able to agree to these terms. If you use Push Up on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.
Bookings and gym services
Class availability, membership eligibility, waitlists, cancellations, charges and attendance rules are set by your gym. A booking made through Push Up is subject to your gym’s terms and policies. Questions or disputes about a class, membership, payment or gym service should be directed to your gym.
We work to keep schedules and booking information accurate, but information supplied by a gym may change. Push Up does not guarantee that a particular class, instructor, time or place will remain available.
Acceptable use
You must not:
- use Push Up unlawfully, fraudulently or in a way that harms another person;
- attempt to access another person’s account or information without permission;
- interfere with the service, its security or its normal operation;
- introduce malicious code or use automated tools to scrape or overload the service; or
- copy, reverse engineer or exploit Push Up except where the law expressly permits it.
Service availability and changes
We may update, improve, suspend or discontinue parts of Push Up. We aim to provide a reliable service, but we cannot promise uninterrupted or error-free availability. Maintenance, security incidents, internet failures and events outside our reasonable control may affect access.
Intellectual property
Push Up and its licensors own the service, software, branding and related intellectual property. We give you a limited, personal, non-exclusive and revocable right to use Push Up for its intended purpose while these terms apply. These terms do not transfer ownership of any intellectual property to you.
Privacy
Our Privacy Policy explains how personal information is handled when you use Push Up. Your gym’s privacy policy may also apply to information it collects or manages.
Suspension and termination
We may restrict or suspend access where reasonably necessary to protect Push Up, its users or others, to investigate suspected misuse, or to comply with law. You may stop using Push Up at any time. Your gym may also change or end your access when your membership or relationship with it changes.
Liability
Nothing in these terms limits rights or remedies that cannot legally be limited, including rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
To the extent permitted by law, Push Up is not responsible for indirect or consequential loss, loss of profit, loss of data, or loss arising from services supplied by a gym or another third party. Where Push Up is liable and the law permits a limit, our total liability to you will not exceed NZD $100.
Changes to these terms
We may update these terms to reflect changes to Push Up, our business or the law. We will publish the current version here and update the date above. If a change materially affects your rights, we will take reasonable steps to provide notice.
Governing law
These terms are governed by New Zealand law. The courts of New Zealand have non-exclusive jurisdiction over disputes relating to these terms or Push Up.
